A nurse practitioner (NP) cared for a 15-year-old male at an outpatient clinic.

A nurse practitioner (NP) cared for a 15-year-old male at an outpatient clinic. The chief complaints of the 15-year-old and his mother at the time of the visit included a lack of appetite, nausea and vomiting, and some abdominal pain. A urine test revealed hematuria, and the NP diagnosed the patient with viral gastroenteritis. One week later, the patient is transported to the emergency room with a ruptured appendix, requiring immediate surgery. The patient fully recovered from the emergency appendectomy. The parents of the patient file a lawsuit against the NP for malpractice and the outpatient clinic for inadequate supervision of the NP, claiming that a correct diagnosis would have prevented prolonged discomfort and emergency surgery, as well as their loss of wages resulting from the presurgical and postsurgical care needed for their son. You are an NP who has been hired as an expert witness and consultant by the insurance company representing the outpatient clinic. The attorney representing the NP has asked you to review the case and identify any concerns or further information that would help in resolving this case.
Case Questions
1. Because the NP is being accused of malpractice, you are asked to review the case to determine whether malpractice has occurred based on the required conditions. What are the three conditions that must exist to establish malpractice
2. While reviewing the case file, you note that the insurance company is representing the clinic. If the clinic is determined to be “not guilty” of failing to provide adequate supervision of the NP, how could this affect the NP
3. What are some tips you could give the NP to avoid or reduce the possibility of legal issues?

Topic
Identify a topic/area of health need in your community, your state, or the nation. (You may not select a topic in your work setting.) How does your selected health initiative play a role in the health of the people of your community?
Health need topics could include nutritious school lunches, obesity, inactivity, immunizations, school nurses, health care/medications for the mentally ill, homelessness, STDs, health disparities, school health for children with diabetes or asthma, APRN practice, the opioid epidemic, medical marijuana, barriers to healthcare access for Native Americans, changing the West Virginia state (or another state) practice law for nurse practitioners, nurse practitioner rural independent practice in Iowa (or another state), rural telemedicine for psych clients, U.S. maternal mortality, e-cigarette use in adolescents, food allergies in schools, or healthcare barriers for illegal immigrants.
The topics are too numerous to mention them all. Think about your nursing experiences and your knowledge of healthcare systems when choosing your topic.
Clearly identify the topic of the health initiative (be sure to include the population you wish to address) and why you chose it. Identify data and/or public policy to support your choice.
(Your section instructor should have approved your topic in Week 5.)
The Plan
State at least two specific outcomes that you wish to achieve. Make sure the outcomes are measurable using SMART goals. Specifically state how you will measure that outcomes were met. What is your plan to address this health initiative? Be specific.
How will you notify the public/concerned parties that there is a problem? For example, if you choose to write a letter to the editor or to your congressperson, what will you put in the letter?
Will anyone assist you in developing or implementing your initiative? Be specific about their roles. Will you seek input from any group of people?
What specifics are involved in your plan—an article for a paper, presentation at church, parent/teacher meeting, etc.?
