LEGAL ISSUES IN HRM
1. Scenario: One of your nurses (Sandy) in a large clinic is nearing the end of her FMLA leave. She went on leave to take care of her mother, who is terminally ill with cancer. She has now requested an additional six to eight weeks of leave. The clinic manager’s response was that Sandy had requested and been granted 12 weeks of FMLA leave, but she was needed back in the clinic when that leave concluded. Sandy contacts the HR office and says that she has several fellow employees who are willing to donate additional leave to help cover her further absence. She also tells HR that she believes her manager’s denial of further leave is in retaliation for her request for FMLA leave in the first place.
Answer the following questions:

1. Could the denial of additional leave be considered retaliation under the FMLA?
2. Does the availability of donated leave from other employees help or hinder this situation? Why?
3. How might this situation be resolved?
4. Develop a question related to the discussion topic.
